Welcome to Littos. These Terms of Service (“Terms”) apply when you visit, use or purchase from www.littos.co.nz and any related services we provide (together, the “Services”).

In these Terms, “Littos”, “we”, “us” and “our” refer to the operator of the Littos store.

By accessing the Services or placing an order, you agree to these Terms together with our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree to these Terms, please do not use the Services.

1. Your Information and Account

When placing an order or creating an account, you agree to provide accurate, current and complete information.

You are responsible for maintaining the security of your account credentials and for activity carried out through your account.

You must be legally capable of entering into a contract in your jurisdiction. Where required by law, minors may only use the Services with the involvement and permission of a parent or legal guardian.

2. Littos Products

Littos Coffee Chews are food products.

We take reasonable care to accurately describe and display our products. However, product colours, appearance, packaging and other visual details may vary slightly due to screen settings, photography, normal manufacturing variations or packaging updates.

Please review the ingredient list, allergen information, caffeine information where applicable, serving guidance and any warnings shown on the product page or packaging before consuming a product.

Individual taste, caffeine tolerance and response may vary. If you are pregnant or breastfeeding, sensitive to caffeine, taking medication, have a medical condition, or are otherwise unsure whether a product is suitable for you, seek appropriate professional advice before use.

Information provided on our website is for general product information only and is not medical advice. Our products and website content are not intended to diagnose, treat, cure or prevent any disease or medical condition.

3. Orders

When you place an order, you are making an offer to purchase the products in your cart.

We may decline or cancel an order before dispatch where reasonably necessary, including where:

• a product is unavailable;
• payment cannot be authorised;
• we reasonably suspect fraud or misuse;
• an order breaches applicable purchase limits; or
• there is an obvious pricing, product or technical error.

If we cancel an order after payment has been taken, the amount paid for the cancelled item or order will be refunded to the original payment method.

Please check your order carefully before completing checkout. If you need to request a change or cancellation, contact us as soon as possible at info@littos.co.nz. We cannot guarantee that an order can be changed or cancelled once fulfilment has started or the order has been dispatched.

4. Prices and Payment

Prices are displayed in the currency shown on the website or at checkout and may vary between markets.

The price applicable to your purchase is the price shown at checkout when you submit your order, subject to correction of obvious errors.

Shipping charges, applicable taxes and other charges collected by Littos will be displayed at checkout where applicable.

For international orders, customs duties, import taxes, brokerage charges or other destination-specific fees may be payable directly by you unless we expressly state that they are included.

Your bank, card provider or payment provider may also charge currency conversion or transaction fees.

By submitting payment information, you confirm that you are authorised to use the payment method provided.

5. Shipping and Delivery

Current shipping options and estimated delivery times are available in our Shipping Policy.

Delivery times are estimates rather than guarantees. Delivery may be affected by courier networks, customs processing, public holidays, weather events and other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address.

If an order is delayed or returned because incorrect or incomplete delivery information was provided, additional shipping charges may apply where permitted by law.

Nothing in this section limits any rights you may have under applicable consumer law.

6. Returns and Refunds

Returns and refunds are governed by our Refund Policy.

For change-of-mind returns, unopened and unused Littos Coffee Chews purchased directly from Littos may be eligible for return within 30 days of delivery, provided they remain sealed, in their original packaging and in resalable condition.

For eligible change-of-mind returns, return shipping costs are the responsibility of the customer and original shipping charges are non-refundable.

Because Littos Coffee Chews are food products, opened products or products with a broken original seal are not eligible for a change-of-mind return, refund or exchange based on taste or personal preference.

This does not affect your rights where a product is faulty, damaged, unsafe, incorrectly supplied, or where applicable law otherwise provides you with a remedy.

7. Subscriptions and Recurring Purchases

If Littos offers a subscription or recurring purchase option, the applicable price, billing frequency, delivery frequency, discount, renewal terms and cancellation conditions will be shown before you complete the purchase.

By selecting a subscription, you authorise recurring charges in accordance with the terms presented at checkout until the subscription is cancelled or otherwise ends.

Where subscriptions are available, you will be able to manage or cancel them using the method provided with the subscription service or by contacting us at info@littos.co.nz.

Any mandatory cancellation or renewal rights available under applicable law remain unaffected.

8. Promotions, Bundles and Offers

From time to time, Littos may offer discounts, bundles, free gifts, promotional codes or limited-time offers.

Additional conditions may apply to individual promotions and will be stated with the relevant offer.

Unless otherwise stated, promotions cannot be combined, transferred or redeemed for cash.

We may withdraw, correct or refuse an offer affected by an obvious error, technical issue, fraud or misuse, subject to applicable law.

9. Acceptable Use

You may use our website only for lawful purposes.

You must not misuse the Services by attempting unauthorised access, interfering with website security or operation, introducing malicious code, committing fraud, impersonating another person, infringing intellectual property rights or using the Services in any other unlawful manner.

We may restrict access where we reasonably believe this is necessary to protect Littos, our customers, the Services or third parties.

10. Intellectual Property

The Littos name, logos, product designs, packaging, website design, copy, photography, graphics, videos and other content made available through the Services are owned by or licensed to Littos and are protected by applicable intellectual property laws.

You may access and use our website for ordinary personal shopping purposes.

You may not reproduce, distribute, modify, sell, license or commercially exploit our content without our prior written permission, except where permitted by law.

11. Third-Party Services

Our online store is powered by Shopify and may use third-party providers for services including payments, shipping, subscriptions, analytics, marketing and customer support.

Certain third-party services may be subject to their own terms and privacy practices.

Our website may also contain links to third-party websites. We are not responsible for third-party content, products or services, except to the extent responsibility cannot lawfully be excluded.

12. Privacy

Our collection, use and disclosure of personal information is described in our Privacy Policy.

Shopify and other service providers may also process information as necessary to operate our store and provide the Services.

13. Errors and Availability

We may correct typographical errors, inaccurate product information, pricing mistakes or availability information and update the Services from time to time.

If a correction materially affects an order you have already placed, we will contact you where appropriate and provide any remedy required by applicable law.

14. Consumer Rights

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot legally be excluded, restricted or modified.

For consumers in New Zealand, this includes applicable rights under the Consumer Guarantees Act 1993 and protections under the Fair Trading Act 1986.

Goods supplied to consumers must meet applicable legal guarantees, including requirements relating to acceptable quality, safety, fitness for purpose and correspondence with description.

If you purchase from another country or region, you may also have mandatory consumer protections under the laws that apply where you live. These Terms do not remove those mandatory rights.

15. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, we do not guarantee that our website will always be uninterrupted, secure or error-free.

We are not responsible for delays or losses caused solely by events outside our reasonable control.

To the maximum extent permitted by law, Littos will not be liable for indirect or consequential loss that was not reasonably foreseeable as a result of our breach.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including any liability or remedy that cannot be excluded under applicable consumer law.

16. Changes to the Services and These Terms

We may update our products, Services and these Terms from time to time to reflect changes to our business, technology, policies or legal requirements.

The latest version of these Terms will be published on this page with the applicable updated date.

Any changes will apply prospectively from their effective date unless applicable law requires otherwise.

17. Governing Law

These Terms and our provision of the Services are governed by the laws of New Zealand.

If you live outside New Zealand, any mandatory consumer protections or rights that apply in your jurisdiction remain unaffected.

Nothing in these Terms requires you to give up a right to bring a claim before a court or other forum that applicable law requires to remain available to you.

18. Severability and Waiver

If any part of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

If we do not enforce a provision on one occasion, this does not mean we waive our right to enforce it later.
